Driving Without A License Lawyer New York

Driving Without A License Lawyer New YorkDriving without a license throughout New York is a serious offense. It is more severe than a typical traffic violation such as speeding. It is a misdemeanor in many situations. In severe situations, it is a felony. In addition to fines, penalties, and jail time, if you are convicted or plead guilty you will have a criminal record.

Consult with an attorney before you do anything

Don’t pay for any tickets before you’ve spoken with a lawyer. Paying the fine is an admission of guilt, and you will collect points. If you do not respond, you can still be found guilty. In most cases, you do not have to appear in court. As your lawyer, I can stand in your place in court and in negotiations, saving you precious time and money if you live far away. In many cases, I can reduce a traffic ticket to a lesser charge or a non-moving violation.

I’m Jonathan D. Katz, Esq. and I’ve been practicing law and defending traffic citations in the state of New York for over 36 years. I can help you whether you’re a local resident, a New York driver, an out-of-state driver, or even a Canadian driver.

Unlicensed operation – two types of violations

There are two types of unlicensed operation violations:

  1. Unlicensed operation of a motor vehicle – This is a misdemeanor under Section 509 of the New York Vehicle and Traffic Code. It is typically issued when you are properly licensed but do not have the actual license with you, or when your license expired not long before your ticket.
  2. Aggravated unlicensed operation of a motor vehicle – A first-degree aggravated offense is a felony under Section 511. It carries a heavy fine and potential jail penalty. A second or third-degree AUO is a misdemeanor that carries fewer fines and lesser jail time.

Potential defense strategies

You may have a potentially successful defense strategy that will help to get your ticket reduced or even eliminated. Perhaps you weren’t notified of an expired license from DMV or you believe that you are properly licensed in another state. In addition, different courts and prosecutors in the state of New York view these offenses in different ways.

I have handled a large number of both unlicensed operation and aggravated unlicensed operation cases over the course of my career, as well as traffic cases involving lack of insurance. In your case, I will use my knowledge and experience to obtain the best possible outcome for you. In some cases, that might even mean getting the charge reduced to a non-moving violation. My goal will be to minimize the consequences, including the fine and effect on your driving record.
